Terms and Conditions

These are perforce of a legal nature. However our policy is to apply them in a sensible and reasonable manner.

1. General

All quotations are made, all orders accepted, all goods sold, all service and advice rendered subject to these conditions and to the exclusion of any previous Conditions of Purchase. Any variations to these must be expressly accepted by us in writing.

2. Specifications

We reserve the right to supply goods to the specification and/or design current at the date of despatch. We cannot accept a request for goods as previously supplied, as binding.

3. Delivery

Delivery times quoted are to be treated as an estimate only and Alpha Laboratories shall not be liable for any failure to deliver within such times whether a time for delivery be quoted or not. We shall not be held responsible for delays caused by anything beyond our reasonable control. Any special delivery requirements must be notified to us in writing at the time of placing the order. We shall have the right at our discretion to make a reasonable charge for special handling and/or delivery.

For orders placed online via our website (www.alphalabs.co.uk), we will ship to the delivery address entered in our Checkout Step 1. For the avoidance of doubt, where Paypal is used as the Payment Method, any delivery address entered during the Paypal process will be superceded by the delivery address entered on the Alpha Laboratories website at Checkout Step1.

4. Loss or Damage in Transit

No claim for breakages or missing goods can be recognised unless notified to Alpha Laboratories and the carriers within 48 hours of receipt of the consignment. In the case of non-delivery of a complete consignment notification must be received by us within 10 days of invoice date.

5. Return of Goods

Should it be necessary for goods to be returned to Alpha, for whatever reason, please contact our Customer Service Department for a Returned Goods Authorisation Number. Clearly mark the Authorisation Number on the package to ensure your goods can be speedily processed.

You will appreciate that we cannot accept responsibility for loss or damage to goods being returned to us unless we arranged collection.

If the mistake was ours there is of course no charge to you. However, if the goods were incorrectly ordered an input and re-stocking charge of 12% of the invoice value excluding VAT is chargeable.

6. Small Order/Packaging Charges

A minimum order delivery value (exclusive of VAT) of £80.00 is necessary to avoid the small order administration surcharge of £10.00. Please also note that we reserve the right to add to the price a reasonable charge for packing pallets or containers or for the delivery of goods in pack sizes which differ from those offered in the catalogue.

7. VAT Zero Rated Orders

VAT Zero Rated Orders must be accompanied by an exemption certificate unless special arrangements have been made in writing. Under circumstances where a VAT exemption certificate does not accompany an order we are obliged by law to charge VAT. If subsequently you reclaim a VAT credit it must be effected within 30 days of invoice date.

8. Prices

Alpha Laboratories reserve the right to alter prices without prior notice. Unless otherwise agreed the price of the goods shall be that ruling on the date of dispatch. All prices given are exclusive of Value Added Tax unless otherwise stated. Any additional tests requested to be undertaken on goods such as Certificates of Conformity may be subject to a charge. Alpha Laboratories cannot accept responsibility for typographical errors in pricing in our catalogues, website, advertising literature or quotations. All orders requesting discounts must be accompanied by a quotation number previously supplied by our Customer Service Team in writing.

9. Payment

Normal terms are strictly 28 days nett unless otherwise agreed in writing. We may at our discretion charge interest at the rate of 5% above the base lending rate of Barclays Bank plc on all overdue accounts to the date of actual payment. Payment in advance or financial guarantees may be requested from customers who do not have an account.

10. Cancellation

Orders may not be cancelled without our prior written agreement and may be subject to a cancellation charge. Standing orders must be cancelled in writing at least 8 weeks prior to what becomes the last shipment date. Subscription orders for human red cell products are naturally a special case and written notice is necessary three months prior to what becomes the last shipment date.

11. Liability

Alpha Laboratories’ liability for any loss or damage suffered by you and arising by way of defects in the goods or otherwise howsoever shall be limited to the invoice price of the goods in respect of or in relation to which loss or damage is claimed. Our liability under this clause shall be in lieu of any warranty or condition implied by law as to the quality or fitness for any particular purpose of the goods and save as provided. In this clause we shall not be under any liability, whether in contract, tort, breach of statutory duty or otherwise in respect of defects in goods delivered or for any injury (other than death or personal injury caused by our negligence as defined in the Unfair Contract Terms Act, Oct 2003) damage or loss resulting from such defect or from any information, service or advice rendered by us or our employees or agents.

12. Title

Goods remain the property of Alpha Laboratories until paid for in full.

Health & Safety at Work Act

This Act requires that we must inform all customers of the hazards and handling requirements in the use of our products. It is recommended that products from this company be handled only by those persons who are properly qualified in the handling and use of toxic and hazardous reagents and chemicals. Our products are for in-vitro use only. Products which contain materials derived from human sources should be treated as though capable of transmitting infection. Testing components for Hepatitis B Surface Antigen and HIV have been performed in compliance with current recommendations.

Control of Substances Hazardous to Health Regulations 2002

In accordance with the guidelines laid down in the COSHH Regs 2002 Product Safety Data Sheets are available on request.
